Piecepool Terms of Service

Article 1 (Purpose)

These Terms of Service (the "Terms") set forth the rights, obligations, and responsibilities of unsober (the "Company") and users, as well as the conditions and procedures for use, in connection with the Piecepool service (the "Service") provided by the Company.

Article 2 (Definitions)

(1) "Service" means the music discovery platform provided by the Company through which users discover music that is not widely known to the public and leave records of their discoveries, and through which artists may introduce portions of their own recordings.

(2) "Member" means a person who agrees to these Terms, signs up through social account authentication, and uses the Service.

(3) "Dig" means the act by which a Member records that they have discovered a particular song within the Service, and "dig record" means a record that includes the time of the dig, the Member's profile name, and any Log written by the Member.

(4) "POOL" means the space within the Service where an artist Member may register their own song as a clip of up to 30 seconds and expose it to other Members.

(5) "Clip" means a portion of a recording of up to 30 seconds registered in the POOL, together with accompanying information such as the song title, artist name, and genre.

(6) "Post" means any content a Member has posted to the Service, including Logs, clips, and all other content.

(7) Terms not defined in this Article shall be governed by applicable laws and the Service guidelines.

Article 3 (Posting, Effect, and Amendment of the Terms)

(1) The Company publishes these Terms on the Service screen, and the Terms take effect when a user who has agreed to them signs up for the Service.

(2) The Company may amend these Terms to the extent not in violation of applicable laws. In the event of an amendment, the Company will announce the effective date and the reasons for the amendment within the Service from 7 days before the effective date (30 days for changes unfavorable to users).

(3) A Member who continues to use the Service after the effective date of the amended Terms is deemed to have agreed to the amended Terms. A Member who does not agree to the amended Terms may terminate the service agreement (withdraw from membership).

Article 4 (Provision and Modification of the Service)

(1) The Company provides the following services: 1. music discovery and dig record services; 2. the POOL (clip registration and exposure) service; 3. any other services determined by the Company.

(2) The Service is provided, in principle, 24 hours a day, year-round; provided that the Company may modify or discontinue all or part of the Service as operationally or technically necessary, in which case prior notice will be given within the Service.

(3) Whether a song is eligible for digging may be determined automatically according to criteria set by the Company (such as assessment of public recognition), and such criteria and results may change in accordance with the Service's operating policies.

Article 5 (Suspension of the Service)

(1) The Company may temporarily suspend the provision of the Service in the event of maintenance, replacement, or failure of facilities, interruption of telecommunications, natural disasters, or other events of force majeure.

(2) The Company shall not be liable for damages incurred by Members due to temporary suspension of the Service provided free of charge, unless caused by the Company's willful misconduct or gross negligence.

Article 6 (Membership Registration)

(1) Membership is established when a user agrees to these Terms and to the collection and use of personal information and completes social account (e.g., Google) authentication.

(2) Persons under the age of 14 may not register as Members.

(3) The Company may refuse to accept, or subsequently terminate, a registration that falls under any of the following: 1. use of another person's account or identity; 2. a history of restricted use due to past violation of these Terms; 3. registration for any other improper purpose.

Article 7 (Withdrawal and Loss of Membership)

(1) A Member may request withdrawal at any time through the in-Service feature or the contact channel, and the Company will process the request without delay.

(2) If a Member violates these Terms, the Company may restrict use or terminate the service agreement after prior notice; provided that where an unlawful act such as copyright infringement is evident or urgent measures are required, the Company may act without prior notice.

(3) Upon withdrawal or loss of membership, Posts shall be handled in accordance with Articles 12 and 13.

Article 8 (Notice to Members)

(1) The Company may give notice to a Member by in-Service notification or by posting an announcement, and notice to all Members may be substituted by posting within the Service for 7 days or longer.

Article 9 (Protection of Personal Information)

(1) The Company protects Members' personal information in accordance with applicable laws, and matters concerning the processing of personal information are governed by the separate Privacy Policy.

Article 10 (Obligations of the Company)

(1) The Company shall not engage in conduct prohibited by applicable laws or these Terms, and shall do its best to provide the Service in a stable manner.

(2) Where the Company recognizes that an opinion or complaint raised by a Member is justified, it will handle the matter and inform the Member of the process and outcome.

Article 11 (Obligations of Users)

(1) A Member shall not engage in any of the following acts:

1. infringing the intellectual property rights of others, including copyright, neighboring rights, and trademark rights, or other rights such as portrait rights and reputation;

2. registering in the POOL any recording or content in which the Member holds no lawful rights;

3. registering false information, such as making a clip and its registered release link point to different songs;

4. improperly manipulating the Service's evaluation systems, such as dig records and scores (use of multiple accounts, collusion, etc.);

5. creating inappropriate Posts such as profanity, hate speech, or spam;

6. repeatedly filing false reports;

7. interfering with the normal operation of the Service (use of automated programs, server attacks, etc.);

8. any other act in violation of applicable laws or public order and morals.

(2) If a Member violates Paragraph (1), the Company may take measures such as withholding or deleting the exposure of Posts, restricting use, or terminating the service agreement.

Article 12 (Nature of Dig Records)

(1) Dig records are an essential function of the Service and are disclosed, together with the Member's profile name, to other users and to non-logged-in visitors.

(2) A dig record is a record proving the order of discovery. Within 24 hours of creating it, a Member may cancel the dig or edit the Log (the time of the dig, its order, and the emotion tags do not change). After 24 hours it can be neither canceled nor modified. A canceled record cannot be restored, and the same song cannot be dug again. Members are deemed to have understood and agreed to this nature upon signing up and upon digging.

(3) When a Member withdraws, the profile name on their dig records is de-identified, and the records themselves may be retained for the integrity of the Service (such as other Members' discovery rankings). However, the Member may request deletion of the Logs they have written upon withdrawal.

Article 13 (POOL Content and Warranty of Rights)

(1) A Member who registers a clip in the POOL (the "Registrant") warrants that they hold lawful rights to the recording (copyright, neighboring rights, or a license from the rights holder).

(2) The Registrant grants the Company a non-exclusive license to store, reproduce, transmit, and stream the registered clip within the scope of operating, providing, and promoting the Service. This license terminates when the clip is taken down from the Service or the Registrant requests its deletion.

(3) The Registrant bears all responsibility for disputes with third parties arising from the registration of a clip (including, without limitation, claims of copyright infringement); the Company merely provides the Service in reliance on the Registrant's warranty of rights and does not guarantee the legality of the content in advance.

(4) If the Company suffers damage due to the Registrant's breach of the warranty of rights (including third-party damage claims and litigation costs), the Registrant shall compensate the Company for such damage.

(5) A registrant may withdraw a clip at any time. The clip is removed from the Service immediately; records that are not the recording itself — other members' dig records (order, time, Log) — remain under Article 12.

(6) Where a clip contains third-party works (samples, co-written material), the registrant also warrants that the necessary permissions have been obtained.

Article 14 (Reports of Rights Infringement and Measures)

(1) A person claiming that their rights have been infringed may substantiate the infringement through the in-Service reporting feature or by email ([email protected]) and request deletion of the Post or suspension of its exposure.

(2) The Company will withhold, without delay, the exposure of a Post for which an infringement report has been received, and will give the Registrant an opportunity to substantiate their rights. If the Registrant fails to substantiate lawful rights within a reasonable period, the Post will be deleted.

(3) The Company may terminate the service agreement with a Registrant who repeatedly infringes copyright.

(4) Where the Company has withheld exposure or deleted a Post in accordance with the procedure in Paragraph (2), the Company may be exempted from liability for the infringement pursuant to Articles 102 and 103 of the Copyright Act of Korea.

Article 15 (Management of Posts)

(1) If the Company determines that a Post violates Article 11 or applicable laws, it may take measures such as withholding exposure, hiding, or deleting the Post without prior notice.

(2) Even where a Log is hidden due to a report or otherwise, the dig record itself (the time and order of discovery) is retained in accordance with Article 12.

Article 16 (Attribution of Intellectual Property Rights)

(1) Intellectual property rights in the Service itself (software, design, databases, scoring systems, etc.) belong to the Company.

(2) Intellectual property rights in a Post belong to the Member who created it, and the Company uses it only within the scope of the license under Article 13(2) and as necessary for operating the Service.

(3) A Member shall not, without the Company's prior consent, use information obtained through the Service for commercial purposes by reproducing, transmitting, publishing, or distributing it, or allow a third party to use it.

Article 17 (Damages and Disclaimer)

(1) As a provider of information and communications services, the Company is not responsible for the content posted by Members, and legal responsibility for a Post rests with the Member who posted it.

(2) With respect to the Service provided free of charge, the Company shall not be liable for damages incurred by Members unless caused by the Company's willful misconduct or gross negligence.

(3) The Company has no obligation to intervene in disputes arising between Members, or between a Member and a third party, through the Service, and is not liable for damages arising therefrom.

(4) Automatically computed indicators within the Service, such as popularity assessments and scores, are for reference only, and the Company does not guarantee their accuracy or completeness.

Article 18 (Dispute Resolution)

(1) The Company operates contact channels (the in-Service contact feature and [email protected]) to handle justified opinions or complaints raised by Members.

Article 19 (Jurisdiction and Governing Law)

(1) These Terms are interpreted in accordance with the laws of the Republic of Korea, and any lawsuit concerning a dispute arising between the Company and a Member in connection with the use of the Service shall be brought before the court of competent jurisdiction under the Civil Procedure Act.

Addendum

These Terms take effect on August 13, 2026.

Amended on September 15, 2026: Article 12(2) was revised to match the actual feature (cancellation and Log editing within 24 hours; no re-digging after cancellation). This broadens users' rights and takes effect on the amendment date.
